These Terms of Service (the “Terms”), together with policies referenced herein, describe your rights and responsibilities when you use the Services.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, do not use the Services.

Delivery times are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control. Title and risk of loss pass to you when we deliver products to the carrier.

RUNGETIT names, logos, and designs are trademarks of RUNGETIT or its licensors. Shopify’s names/logos are trademarks of Shopify. Other marks belong to their owners.

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use of such tools is at your own risk and subject to those third parties’ terms.

The Services may link to third-party sites or include third-party materials. We are not responsible for their content, policies, products, or services. Access them at your own risk and review their policies before engaging in transactions. Complaints or issues should be directed to the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

RUNGETIT is powered by Shopify, which enables us to provide the Services. Sales are made directly by RUNGETIT to you. Shopify is not responsible for your purchases or any injury, damage, or loss resulting from products/services purchased from RUNGETIT. You expressly release Shopify and its affiliates from claims arising from your transactions with RUNGETIT.

Personal information collected through the Services is subject to our Privacy Policy. Certain information may also be processed under Shopify’s Privacy Policy. By using the Services, you acknowledge having read those policies. EXCEPT AS EXPRESSLY STATED BY RUNGETIT, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS; SOME LIMITATIONS MAY NOT APPLY TO YOU.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, RUNGETIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS (AND SHOPIFY AND ITS AFFILIATES) SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR LOST PROFITS/REVENUE/SAVINGS/ DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE OR USD $100, WHICHEVER IS GREATER. SOME JURISDICTIONS LIMIT LIABILITY WAIVERS; SOME LIMITATIONS MAY NOT APPLY TO YOU.

SECTION 17 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless RUNGETIT, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of: (1) your breach of these Terms or referenced policies; (2) your violation of laws or third-party rights; or (3) your use of the Services. We may control the defense/settlement at your expense and will not settle claims requiring your non-monetary obligations without your consent (not unreasonably withheld).

SECTION 18 – SEVERABILITY

If any provision of these Terms is unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will remain in effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to enforce any right or provision is not a waiver. These Terms, together with policies posted on the site, constitute the entire agreement between you and RUNGETIT regarding the Services and supersede prior agreements. Ambiguities shall not be construed against the drafting party.

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

SECTION 21 – GOVERNING LAW

These Terms and any disputes arising out of or relating to the Services are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in St. Louis County, Missouri.
